Employment disciplinary proceedings must comply with both contractual procedures (as specified in employment contracts, collective agreements, or staff manuals) and natural justice principles. Breach of either renders proceedings void. Contractual procedures are binding terms—employers cannot unilaterally disregard them. Natural justice requires: notice of charges, opportunity to be heard, right to present evidence and cross-examine, and unbiased decision-makers. Proceedings breaching these requirements are nullities—any resulting dismissal or disciplinary action is invalid and unenforceable. This protects employees from arbitrary discipline and ensures procedural fairness.
