Per Oguntade, JSC, in Saleh v. Monguno (2006) NLC-123-403-2001(SC) at p. 38; Paras B–C:
"The consequence of a failure to set aside the sale of appellant's properties is that those properties have been in the hands of other persons for 24 years without a subsisting Court judgment. It is a most unacceptable occurrence."
Explanation / Scope
A sale under a void judgment is itself a nullity. Properties cannot remain in others’ hands without a valid judgment. The principle applies to enforcement of judgments.
