Explanation / Scope

This principle defines the proper scope of a reply brief in appellate practice. A reply brief is not for re-arguing the appellant’s main brief or introducing new grounds of appeal. Its purpose is limited to responding to new issues raised for the first time in the respondent’s brief. It provides clarification and answers to the respondent’s arguments. The principle prevents abuse of the reply brief process and ensures orderly appellate advocacy. Failure to file a reply brief may result in the appellant being deemed to concede new points. The principle applies in all appellate proceedings where briefs are filed.
