Advance Fee Fraud and Other Fraud Related Offences Act, 2006
An Act to prohibit and punish certain offences pertaining to advance fee fraud and other fraud related offences and to repeal other Acts related therewith. The Act creates offences of obtaining property by false pretence, fraudulent invitation, possession of fraudulent documents, laundering of funds obtained through unlawful activity, and other fraud-related offences. It imposes penalties including imprisonment terms without the option of a fine, establishes duties for electronic communication service providers and telecommunications/internet service providers, confers jurisdiction on the Federal High Court and State High Courts, provides for the control and forfeiture of property of accused persons, including non-conviction-based forfeiture, and makes provisions for restitution to victims. The Act repealed the Advance Fee Fraud and Other Fraud Related Offences Act No. 13 of 1995 and the Advance Fee Fraud and Other Fraud Related Offences (Amendment) Act, 2005.
