"The third ground of appeal is the omnibus ground which is a complaint on the weight of evidence. This generally is regarded as a ground of fact in a civil case."
Explanation / Scope
An omnibus ground of appeal, which complains about the weight of evidence, is generally regarded as a ground of fact in civil cases. Such a ground invites the appellate court to re-evaluate the evidence. It does not raise a pure question of law and therefore may require leave.
