Order 12 — APPLICATION FOR ACCOUNT
Rule 1 Order for Account
Where in an originating process a claimant seeks an account under Order 4 Rule 5 or where the claim involves taking an account, if the defendant either fails to appear, or after appearance fails to satisfy a judge that there is a preliminary question to be tried, the judge shall, on application make an order for the order for account, with all necessary inquiries and directions.
Rule 2 Application How Made
An application for account shall be supported by an affidavit, stating concisely the grounds of the claimant’s claim to an account. The application may be made at any time after the time prescribed for defence.
Rule 3 Account May Be Taken by a Judge or Referee
Where an order is made for account under this Order, the account may be taken by a Judge or a Referee appointed by the Judge.
