Order 2 — PLACE OF INSTITUTING AND TRIAL OF SUITS
Rule 1 Suit Relating to Land and Property Distrained or Seized
Subject to the provisions of the law on transfer of suits, the place for trial of any suit shall be regulated as follows:
All suit relating to land or any mortgage or charge on or any interest in land, or any injury or damage to land and actions relating to property distrained or seized for any cause, shall be commenced and determined in the Judicial Division in which the land is situated, or the distrain or took place.
Rule 2 Suit for Recovery of Penalties, Forfeitures and Against Public Officers
All actions for recovery of penalties, forfeitures, and all actions against public officers shall be commenced and tried in the Judicial Division in which the cause of action arose.
Rule 3 Suit Upon Contract
All suits for the specific performance, or upon the breach of any contract, may be commenced and determined in the Judicial Division in which such contract was entered into or ought to have been performed or in which the Defendant resides or carries on business.
Rule 4 Other Suit
(1) All other suits may be commenced and determined in the Judicial Division in which the cause of action arose or where the defendant resides or carries on business.
(2) Where there are several defendants who reside or carry on business in different Judicial Divisions, the suit may be commenced in any one of those Judicial Divisions subject to any order or direction a Judge may make or give as to the most convenient arrangement for trial of the suit.
Rule 5 Suits Commenced in Wrong Judicial Division
(1) If any suit is commenced in the wrong Judicial Division, the presiding Judge shall transfer it to the appropriate division.
(2) A suit commenced in a Judicial Division may be determined in another Judicial Division by the same Judge on the directive of the Chief Judge.
