Order 25 — Proceedings in Lieu of Demurrer
Rule 1 Demurrer abolished
No demurrer shall be allowed.
Rule 2 Points of law may be raised by pleading
(1) Any party may, by that party’s pleading, raise any point of law, and the Judge may dispose of the point so raised before, at or after the trial.
Rule 3 Decision on points raised
(2) If in the opinion of the Judge, the decision on such point of law substantially disposes of the whole proceedings or of any distinct part thereof, the Judge may make such decision as may be just.
